3. Definitions and operating modes
For this Agreement:
- “Direct Call Audio Mode” means functionality that may allow selected App audio to be added directly to an active call through operating-system features, permissions and settings on supported devices.
- “Acoustic Speaker Mode” means ordinary playback through a device speaker so that a nearby telephone microphone may pick up the sound. This may be used on older or unsupported devices, older operating-system versions, Android devices or other phones where Direct Call Audio Mode is unavailable.
- “Sound Effect” means any audio clip, voice, noise, alarm-like sound, siren-like sound or other audio made available through RingRoast.
- “User” or “you” means the person downloading, accessing or using RingRoast and, where applicable, that person’s parent or legal guardian.
4. Purpose and limitations of the App
RingRoast is intended solely for lawful entertainment and personal use. It provides user-controlled Sound Effects, including optional use during unwanted or nuisance calls. RingRoast is not an emergency, security, anti-fraud, call-blocking, medical, communications or professional service.
RingRoast does not identify whether a caller is fraudulent, does not verify a caller’s identity, does not block calls and does not guarantee that use of the App will stop unwanted calls, prevent fraud, produce a particular reaction or achieve any other outcome.
Any marketing description, screenshot, example, demonstration or feature name is illustrative only and does not authorise unlawful, harmful or unsafe conduct or create a guarantee that a particular feature will work on every device, call type or network.
5. Age requirement and parental responsibility
RingRoast is not directed to children under 13 years of age. You must be at least 13 years old and meet any higher minimum age shown in the applicable app store or required by local law.
If you are under the legal age required to enter into a binding agreement where you live, your parent or legal guardian must review and accept this Agreement for you and supervise your use. Parents and guardians are responsible for use by minors under their supervision.
6. Responsible and lawful use
You are solely responsible for deciding how, when, where and with whom you use RingRoast. You must use the App reasonably, safely, lawfully and with due regard for other people.
You are responsible for compliance with all laws, regulations, telephone-network rules, calling-service terms, workplace rules and third-party rights that apply to your conduct, including laws concerning harassment, threats, nuisance communications, privacy, telecommunications, impersonation, public order and consumer protection.
7. Prohibited uses
You must not use RingRoast:
- to harass, stalk, threaten, intimidate, bully, humiliate or deliberately cause serious fear, panic, distress or harm;
- to commit or facilitate fraud, deception, extortion, impersonation or any other unlawful act;
- to impersonate police, emergency personnel, medical personnel, a public authority or another person;
- to falsely simulate or misrepresent a real emergency, accident, collision, weapon, gunshot, explosion, fire, alarm, evacuation, police presence, ambulance, public warning or other safety-critical event;
- during communications with police, fire services, ambulance services, emergency dispatchers, medical professionals, crisis services, security services or other safety-critical services;
- to interfere with emergency, medical, professional, aviation, transport, security, school, workplace or public-service communications;
- while driving, cycling, operating machinery, crossing a road or performing any activity that requires full attention;
- near traffic, crowds, children, animals, hazardous equipment or environments where a sudden sound could cause injury, panic, collision, escape behaviour or property damage;
- to obtain consent, money, credentials or information through deception;
- in violation of another person’s privacy, confidentiality, contractual rights or intellectual-property rights;
- in any way prohibited by the laws or platform rules applicable where you or the recipient are located.
The fact that another person may be an unwanted caller, suspected scammer, telemarketer or nuisance caller does not remove your obligation to act lawfully and safely.
8. Volume, hearing and physical safety
RingRoast contains Sound Effects that may be sudden, loud, repetitive, high-pitched, startling, irritating, distressing or uncomfortable. Hearing sensitivity varies between people and devices.
You must:
- begin at a low system volume and increase it only gradually when reasonably necessary;
- keep the device’s earpiece and speakers away from your ear and every other person’s ear while a Sound Effect is active;
- not hold the device’s earpiece directly against your ear while playing loud or sudden Sound Effects;
- not use headphones, earbuds, hearing aids or other in-ear or on-ear audio devices for loud, sudden or high-pitched Sound Effects;
- never place a phone, speaker, headphone, earbud or other sound source directly against another person’s ear;
- use particular caution around people with hearing conditions, sensory sensitivities, heart conditions, anxiety, post-traumatic stress, epilepsy or other conditions that may be affected by sudden sounds;
- stop playback immediately if you or another person experiences pain, discomfort, ringing, muffled hearing, dizziness, panic, confusion or any unexpected physical or emotional reaction;
- seek appropriate medical advice if symptoms persist or concern you.
RingRoast does not override or bypass your device’s system-volume controls. You remain entirely responsible for selecting a safe volume and audio route.
9. Additional safety rules for Acoustic Speaker Mode
When Direct Call Audio Mode is unavailable and you choose Acoustic Speaker Mode:
- place the call on speakerphone before playing a Sound Effect;
- move the device away from your head and from all ears;
- start at a low volume and raise it only gradually;
- do not create feedback by placing two active phones, microphones or speakers too close together;
- remain aware that noise suppression, echo cancellation and microphone processing may alter or block the sound;
- stop immediately if the sound becomes distorted, unexpectedly loud or causes feedback.
Acoustic Speaker Mode is a fallback method only. It does not guarantee that the other caller will hear the Sound Effect clearly or at all.
10. Assumption of risk
You understand that use or misuse of sudden, loud, repetitive, misleading or alarm-like sounds may cause or contribute to reasonably foreseeable risks, including:
- temporary or permanent hearing damage, tinnitus or other physical discomfort;
- shock, panic, anxiety, stress, confusion or emotional distress;
- distraction, falls, collisions, traffic incidents or other accidents;
- unexpected reactions by people, animals or bystanders;
- personal injury, property damage or damage to devices and audio equipment;
- complaints, disputes, account restrictions, service termination, regulatory action or third-party claims.
By using RingRoast, you knowingly and voluntarily accept the ordinary and reasonably foreseeable risks arising from your own choice of Sound Effect, volume, audio route, timing, location and context. Nothing in this section transfers to you any responsibility that applicable law requires the Developer to retain.
11. Call functionality, device support and compatibility
Direct Call Audio Mode is available only where supported by the relevant device, operating-system version, permissions, accessibility settings, call type, calling application and audio route. On supported Apple devices, this may require a compatible iOS version and activation of the relevant system setting and permission.
Older Apple devices, older operating-system versions, Android devices and other phones may support only Acoustic Speaker Mode. A later App or operating-system update may add, change or remove functionality, but we do not promise that Direct Call Audio Mode will become available for every device or platform.
Whether another caller hears a Sound Effect, and its volume or clarity, may depend on factors outside our control, including:
- device model, hardware and speaker or microphone condition;
- operating-system version, permissions, accessibility settings and system policies;
- telephone network, Wi-Fi or mobile-data connection;
- calling application, call type, conference calling and carrier restrictions;
- Bluetooth, CarPlay, headphones, hearing devices or other selected audio routes;
- echo cancellation, noise suppression, automatic gain control and call-audio processing;
- operating-system, app-store or platform updates.
We do not guarantee that every caller will hear every Sound Effect, that playback will be uninterrupted, or that a feature demonstrated on one device will work identically on another device.
Audio may stop, pause, be interrupted or change route when the App enters the background, the call state changes, another audio session starts or the operating system intervenes. You remain responsible for manually stopping playback where necessary.
12. Permissions, privacy and no call recording
RingRoast may request operating-system permission needed to add or route App audio during calls. Granting a permission does not mean that RingRoast records the call.
RingRoast is not designed to record, store, transcribe, analyse or upload the content of telephone conversations. You must not treat RingRoast as a call-recording, evidence, security or monitoring tool.
At Version 1.0, ordinary preferences and acceptance status are intended to be stored locally on the device. Our current data practices, including any future change to analytics, diagnostics, third-party software or data handling, are described in the Privacy Policy at:
You remain responsible for complying with all privacy, confidentiality, consent and telecommunications laws applicable to your own conduct.
13. Third-party services, networks and charges
RingRoast may rely on hardware, operating systems, app stores, telephone networks, calling applications, accessibility features and other third-party services that we do not own or control. We are not responsible for their availability, operation, policies, changes, outages or restrictions.
Your mobile operator, internet provider, calling service or another third party may impose call, data, roaming or other charges. You are responsible for those charges and for complying with applicable third-party terms.
14. Purchases, pricing and refunds
Purchases are processed by the app store or platform through which you obtain RingRoast. Prices, taxes, payment processing and refund procedures may vary by country and platform.
Refund requests are handled under the applicable app store’s rules and mandatory consumer law. Nothing in this Agreement removes any statutory right to a remedy, refund, repair, replacement or price reduction that cannot legally be excluded.
A feature not being available on an unsupported device does not by itself create a right beyond the rights stated in the relevant store description, app-store rules and applicable law. We will endeavour to describe material device and operating-system limitations accurately in the store listing.
15. License grant and restrictions
Subject to this Agreement, the Developer grants you a personal, limited, revocable, non-exclusive, non-sublicensable and non-transferable license to use RingRoast on devices that you own or control, in accordance with the usage rules of the applicable app store. Where allowed by the platform, authorised accounts may use the App through Family Sharing, volume purchasing or equivalent platform features.
You may not:
- copy, sell, rent, lease, sublicense, commercially redistribute or make RingRoast available as a service to others;
- reverse engineer, decompile, disassemble or attempt to derive source code, except to the limited extent expressly permitted by mandatory law;
- circumvent payment, licensing, security, permission or technical restrictions;
- modify RingRoast to create or distribute an unauthorised or competing copy;
- extract, republish, resell or separately distribute Sound Effects, graphics, icons, text or other App content;
- remove or alter copyright, trademark, licensing or ownership notices.
16. Intellectual property
RingRoast, including its software, source code, object code, design, user interface, branding, icons, graphics, text, original Sound Effects and documentation, is owned by or licensed to the Developer and is protected by applicable intellectual-property laws. No ownership rights are transferred to you.
RingRoast™ and associated branding may not be used in a way that suggests endorsement, ownership or affiliation without prior written permission. Any third-party names or marks remain the property of their respective owners.
17. Availability, maintenance, updates and discontinuation
RingRoast is provided on an “as is” and “as available” basis. We may provide maintenance, corrections, security changes, compatibility updates, new Sound Effects or feature changes, but we do not guarantee a particular update schedule or permanent availability of any feature or Sound Effect.
We may change, suspend, replace or discontinue features where reasonably necessary for safety, security, legal compliance, platform compliance, technical compatibility or commercial reasons. Where required by mandatory law, we will provide appropriate notice or remedies.
You are responsible for installing available App and operating-system updates that are reasonably necessary for safety or functionality. Continuing to use an outdated version may limit features or increase compatibility problems.
18. Warranties and disclaimers
To the maximum extent permitted by applicable law, RingRoast is provided without warranties or conditions not expressly stated in this Agreement, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, uninterrupted operation or error-free performance.
We do not warrant that RingRoast will always be available, secure, uninterrupted, compatible with every device or service, free from defects, or capable of transmitting every Sound Effect clearly to another caller.
Nothing in this Agreement excludes or restricts any statutory guarantee, conformity obligation or consumer right that cannot legally be excluded or restricted.
19. Limitation of liability
Nothing in this Agreement excludes or limits liability where exclusion or limitation is prohibited by law, including, where applicable, liability for fraud, wilful misconduct, deliberate recklessness, death or personal injury caused by legally attributable negligence, mandatory product liability, or mandatory consumer rights.
Subject to the previous paragraph and to the maximum extent permitted by law, the Developer will not be liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, income, business, opportunity, reputation, goodwill or data, arising from or connected with your use or inability to use RingRoast.
Subject to mandatory law, the Developer is not responsible for loss or damage caused by your unsafe, unlawful, reckless or unauthorised use; your chosen volume or audio route; use with headphones, earbuds or hearing devices; use while driving or in a hazardous environment; false emergency simulation; third-party networks, services or devices; or failure to install a reasonably necessary update.
Where liability for direct financial loss may legally be limited, the Developer’s total aggregate liability arising from RingRoast will not exceed the greater of the amount you paid for the App and EUR 100. This cap does not apply to liability that cannot legally be capped.
20. Third-party claims and indemnity
To the maximum extent permitted by law, you are responsible for third-party claims, losses, penalties and reasonable costs directly caused by your intentional unlawful use, fraudulent use, false emergency simulation, infringement of third-party rights or material breach of this Agreement.
You agree to reimburse and hold the Developer harmless from such claims and reasonable costs only to the extent they are legally attributable to your conduct. This clause does not apply where it would be unlawful, disproportionate or unfair under mandatory consumer law, or to the extent a claim was caused by the Developer.
21. Suspension and termination
Your license ends automatically if you materially breach this Agreement. We may also suspend or terminate access where reasonably necessary because of serious or repeated misuse, unlawful activity, attempted circumvention of security or payment systems, a threat to users or third parties, or a legal or platform requirement.
Upon termination, you must stop using RingRoast and remove copies under your control where reasonably possible. Provisions that by their nature should continue, including intellectual property, liability, governing law and third-party-beneficiary provisions, remain effective.
22. App store platform terms
The following platform-specific terms apply in addition to the rest of this Agreement.
22.1 Apple App Store
- This Agreement is between you and the Developer only, not Apple. The Developer, not Apple, is solely responsible for RingRoast and its content.
- Your license is limited to use on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules, including permitted Family Sharing or volume purchasing.
- The Developer is solely responsible for maintenance and support required under this Agreement or applicable law. Apple has no obligation to provide maintenance or support.
- The Developer is responsible for applicable product warranties to the extent not effectively disclaimed. If RingRoast fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price in accordance with its rules. To the maximum extent permitted by law, Apple has no other warranty obligation.
- The Developer, not Apple, is responsible for addressing claims relating to RingRoast or your possession or use of it, including product-liability claims, legal or regulatory compliance claims, and claims under consumer-protection, privacy or similar law.
- If a third party claims that RingRoast or your possession and use of it infringes intellectual-property rights, the Developer, not Apple, is responsible for investigation, defence, settlement and discharge of that claim.
- You must comply with applicable third-party agreements, including your wireless-data, telephone-network and calling-service agreements.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple has the right to enforce the Apple-specific provisions against you as a third-party beneficiary.
22.2 Google Play
- If you obtain RingRoast through Google Play, this Agreement is between you and the Developer, not Google.
- Your use is also subject to the applicable Google Play terms, policies and usage rules.
- The Developer, not Google, is responsible for RingRoast, its content, maintenance, support and claims relating to the App, except to the extent Google has obligations under its own terms or mandatory law.
- Purchases and refunds processed through Google Play are also subject to Google Play’s procedures and applicable consumer law.
23. Export controls and sanctions compliance
You represent that you are not located in a country or region subject to an applicable government embargo or designated as supporting terrorism, and that you are not listed on an applicable prohibited or restricted-party list. You agree to comply with applicable export-control and sanctions laws.
24. Changes to this Agreement
We may update this Agreement to reflect changes in RingRoast, safety information, laws, business details, app-store requirements or platform functionality. The version number and date at the top identify the current version.
Where a change is material, we may require you to review the updated Agreement and tap “I Agree” again before continuing to use RingRoast. Continued use after valid notice and, where required, renewed acceptance constitutes acceptance of the updated Agreement, subject to mandatory law.
25. Governing law and jurisdiction
This Agreement is governed by the laws of the Netherlands, without prejudice to mandatory conflict-of-law rules.
If you are a consumer, this choice of law does not remove any mandatory protection granted to you by the law of the country in which you normally live. Disputes will be submitted to the competent courts of the Netherlands unless mandatory law entitles you to bring proceedings before another court or requires another forum.
26. General provisions
If any provision is found invalid, unlawful or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will remain effective.
A failure or delay in enforcing a provision is not a waiver. You may not assign this Agreement without our written consent, except where mandatory law permits. We may assign it as part of a genuine transfer of RingRoast or the relevant business, provided this does not reduce mandatory consumer rights.
This Agreement, together with the Privacy Policy, applicable app-store terms and any mandatory consumer terms, forms the entire agreement concerning your use of RingRoast. No third party has enforcement rights except Apple and its subsidiaries as expressly stated in Section 22.1, or where mandatory law provides otherwise.
